The way WordPress is licensed, I believe the General Public License extends to WP themes as well, which would allow distribution of any theme for any price (including free) that they wanted. Now, obviously stealing the PayPal info is against the law and a whole other issue. However, the GPL issue was discussed in great detail on my blog when I first announced that my theme was for sale. There's a lot of info there that I'm willing to bet most people don't know.
